There is no possibility of a vendor ‘pulling out of a sale’ as contracts are exchanged upon the fall of the gavel, or hammer as it is commonly known.

The properties at a Miller Metcalfe auction will be competitively priced, whether you are looking for a new home, a buy-to-let or other investment opportunity.
Our auctions are scheduled on a regular basis throughout the year and we provide ample opportunity to view the properties prior to the auction date with a member of our experienced auction team.

Before visiting the auction room, it is important that you read the auction terms and conditions. Please take a few minutes to read our top tips and guide to buying at auction.
You can register by e mail for automatic notification of future auctions. You can view our online catalogue in order to give you maximum preparation time, please only print if necessary in order to save the environment.
Contact the auctioneer as early as possible if there are any properties you wish to view.
Ensure you have the funds available to complete the purchase, particularly if you are relying on the sale of another property.
If you require a mortgage, obtain a firm offer from your lender. Please do not hesitate to contact us to arrange mortgage advice and insurance/life policies. (link to mm financial services)
Ensure that your survey, search and legal documentation checks are complete.
In accordance with the Money Laundering Regulations 2003, you will need to provide evidence of identity at the auction prior to obtaining a numbered bidding paddle. Please see below for more information.
Check with the auctioneer for an acceptable method of payment to cover a ten percent deposit.
You must read all the terms and conditions of sale and any Special Conditions before the auction as amendments to the catalogue can be added at a later stage so you must check just prior to auction.
If you do not wish to bid in person, either ask an informed friend to act for you. If you are not present in person, you will still need to provide proof of identity and cleared deposit funds. Please pay careful attention to ensure that you are bidding for the correct lot.
Set yourself a limit for how much you are prepared to bid.
Purchaser Proof of ID – Important New Requirements
In order to conform with the Money Laundering Regulations 2003, all prospective purchasers are required to provide the following to the Auctioneers at the time they register to bid immediately prior to auction;
PERSONAL IDENTIFICATION – Either
1. Currently valid, signed passport or
2. Current UK Driving Licence
EVIDENCE OF ADDRESS – Either
1. Public utility bill issued within the last three months or
2. Local Authority Tax Bill or
3. Bank, Building Society or Credit Union statement containing current address or
4. Most recent original Mortgage Statement or
5. Current UK Driving Licence (if not used as ID document above)
WARNING: YOUR REGISTRATION WILL NOT BE ACCEPTED AND YOU WILL BE UNABLE TO BID IN THE AUCTION UNLESS ADEQUATE IDENTITY DETAILS AND EVIDENCE OF ADDRESS ARE PROVIDED.
Purchasers Responsibility
1. You are advised not to bid if any of the following apply
2. You are unsure
3. You have no deposit with you
4. You have not been registered
5. You have not viewed the lot
6. You have not checked the legal pack
Defaulting Purchasers
Please be aware that any purchaser who fails to complete a purchase of whose cheque is un-cashed will be published in a future catalogue and be barred from future auctions.
Auction Deposits
These are payable on the fall of the hammer and are 10 percent of the purchase price, the following methods of payment are accepted;
1. Banker’s Draft
2. Company Cheque - only if pre-cleared
3. Solicitor’s Client Account Cheque
4. Personal Cheque – only if pre-cleared
5. Cash
Cheques should be payable to Miller Metcalfe Limited as agents for the seller. Deposits taken on behalf of Telephone Bidders must be paid by cheque or CHAPS. Personal and Company Cheques will be taken but these must be accompanied by a £20 cash payment to cover administration costs. Legal Documentation
All legal documentation – THE LEGAL PACK – supplied to us, including the Special Conditions, Permissions, Title Details and Local Authority Searches will be available for inspection in the Auction Room prior to sale.
Pre-Auction Offers
Only offers in writing will be considered and only when the Lot has been inspected, this will be assumed to be your best and final offer and we cannot guarantee you will be invited increase your offer. We reserve the right to refuse any offers below the upper limit of the Guide Price.
Viewings
Viewings of all properties are by prior appointment with the auctioneers. Viewings will be arranged giving courtesy to any tenants in occupation and at times convenient to them. All tenants are under strict instructions not to undertake viewings and interested parties are asked to respect their privacy. Please telephone 08445 76 66 33 to make an arrangement to view, if you should book an auction viewing and fail to attend, you may be charged a ‘no-show fee’.
Administration Charge
Miller Metcalfe Limited apply an administration charge on the sale of each lot payable at the same time as the auction deposit. The administration charge is £200 and is payable by the contractual purchaser.
Guide Prices
Any stated guide price must not be relied upon by bidders as a valuation or assessment and is subject to change. Bidders should make regular checks for changes, eventual sale prices may alter dependent on competition. Bidders should not presume the guide price to be indicative of value.
HIPs
In accordance with current requirements all HIPs are provided and uploaded to our website, these are also available within the legal pack. Hard copy HIPs are however, not available to be taken away from the auction room.
